These Terms of Service ("Terms") govern your use of BlynkAudit ("Service"), operated by Sean Howell ("we", "us", "our"), registered at 1025 Pimpama Jacobs Well Road, Jacobs Well, Queensland, 4208, Australia. By creating an account or using the Service you agree to these Terms.
1. Service Description
BlynkAudit is a website audit and scoring platform. We provide a free tier (a basic score shown in your browser) and paid reports (a full PDF analysis delivered by email). The free tier is limited to 5 audits per day per IP address. The Service works by retrieving and analysing publicly accessible web pages, including pages of businesses other than your own, so that you can run competitive comparisons.
2. Payment Terms
All paid reports are processed via Stripe. Payment is required before a paid report is generated. Prices are shown in USD ($) at the time of purchase and may vary by product or promotion; the price shown at checkout is the price that applies. All payments are one-time charges - no subscription is created unless you explicitly agree to one.
3. Refund Policy
Because each paid report is generated specifically for you on request, we generally do not offer refunds once a report has been delivered to your email address. If a report was not delivered, or was materially defective, due to a technical fault on our part, contact support@blynkaudit.com within 7 days and we will re-deliver it or issue a full refund.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are entitled to limit our liability for failure to meet such a guarantee, our liability is limited, at our option, to re-supplying the report or refunding the amount you paid for it.
4. Acceptable Use
You may use the Service to audit any website that is publicly accessible, including websites you do not own, for analysis and competitive comparison. You agree not to:
- Access, or attempt to access, pages that are not publicly accessible, or bypass authentication, paywalls, or other access controls on a target website
- Submit targets in a way intended to overload, disrupt, or damage a target website or its operator
- Circumvent the Service's own rate limiting or security controls, or submit bulk requests through automated scripts outside our published API
- Use the Service for any unlawful purpose, or in a way that infringes a third party's rights
- Resell or redistribute reports without our written permission
5. Your Responsibility and Indemnity
You are responsible for how you use reports and for ensuring your use of the Service complies with the laws that apply to you. To the extent permitted by law, you agree to indemnify us against third-party claims, losses, and reasonable costs arising from your breach of section 4 or your unlawful use of the Service. This does not apply to the ordinary, intended use of the Service, such as running a competitive comparison of publicly accessible websites.
6. AI-Generated Content
Reports are produced using automated analysis and large language models, including models operated by third-party AI providers. To generate a report we send information about the target website (such as its URL and retrieved page content) to those providers for processing. AI-generated analysis can be incomplete or incorrect and may not reflect the current state of a website. Reports are provided for general information only and are not professional, legal, financial, or technical advice; you should independently verify anything you rely on. The subprocessors we use, and how we handle personal information, are described in our Privacy Policy.
7. Intellectual Property
Reports generated by BlynkAudit are licensed to you and your organisation for internal business use. "Your organisation" means the legal entity you represent when using the Service. You may share reports within your organisation but may not publish or resell them without our written permission.
8. Limitation of Liability
Subject to section 3 and to any rights you have under the Australian Consumer Law, the Service and all reports are provided "as is" and we make no warranty that scores or recommendations are accurate, complete, or suitable for any particular purpose. To the maximum extent permitted by law, our total liability arising out of or in connection with the Service or any report is limited to the amount you paid for the relevant report.
9. Suspension and Changes to the Service
We may suspend or terminate access for any account that breaches these Terms, and we may modify, suspend, or discontinue any part of the Service at any time. Where practical, we will make reasonable efforts to give notice of material changes.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the date above and, where reasonable, notify account holders. Continued use of the Service after the changes take effect means you accept the updated Terms.
11. Privacy
Your use of the Service is also governed by our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
